• Use of this Application/Website

  To the extent that Engidraft does create/display the drawings/contents (“like different types of part drawings, detailed drawings and other services”) on this Application/Website, such contents is protected by intellectual property laws of the India, foreign nations, and international bodies. Unauthorized use of the Application/Website may violate copyright, trademark, and/or other laws. You acknowledge that your use of the drawings on this Application/Website is for personal, noncommercial use. Any links to third-party websites are provided solely as a convenience to you. Engidraft does not endorse the drawings/contents on any such third-party websites. Engidraft is not responsible for the drawings/contents of or any damage that may result from your access to or reliance on these third-party websites. If you link to third-party websites, you do so at your own risk.

  Engidraft is not responsible for any damages resulting from use of this Application/Website by anyone. You will not use the Application/Website for illegal purposes. You will (1) abide by all applicable local, state, national, and international laws and regulations in your use of the Application/Website (including laws regarding intellectual property), (2) not interfere with or disrupt the use and enjoyment of the Application/Website by other users, (3) not resell drawings/contents of the Application/Website, (4) not engage, directly or indirectly, in transmission of "spam", chain letters, junk mail or any other type of unsolicited communication, and (5) not defame, harass, abuse, or disrupt other users of the Application/Website.

  If you breach any of these Terms and Conditions, your authorization to use this Application/Website automatically terminates. Upon termination, you will immediately destroy any downloaded or printed drawings/contents in your possession or control.

  For the purpose of these Terms of Conditions, wherever the context so requires “You” or “User” shall mean any natural or legal person who visits our platform, either just for the purpose of browsing the Application/Website or engages to buy our services. The term “We”, “Us”, “Our” shall mean Engidraft.

• Disclaimers of Warranty

  All drawings/contents supplied hereunder are provided "as is", without warranty of any kind, either expressed or implied, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Engidraft does not warrant that the functions contained in the drawings/contents will be uninterrupted or error-free, that defects will be corrected, or that any Engidraft Application/Website or the services that make materials available are free of viruses or other harmful components. Engidraft does not warrant the accuracy and completeness of the materials on this Application/Website Engidraft may make changes to the drawings/contents and services available at this Application/Website at any time without notice.

• Modification of Terms

  Engidraft reserves the right, at its sole discretion, to change, modify, add or remove portions of these without any prior notice to you. It is your responsibility to review these Terms of Conditions periodically for updates/changes. Changed in Terms and Conditions will become effective once posted on our Application/Website, and will not have any retrospective effect on existing contractual arrangements. You are continued use of Engidraft subsequent to any change in these Terms and Conditions implies your acceptance and agreement of the modified agreement.

  Accessing, browsing or otherwise using Engidraft indicates your agreement to all the Terms and Conditions under these Terms of Use, so please read the Terms of Use carefully before proceeding. If you do not agree with any provision of this agreement then please exit and uninstall the application.

• Limitation of Liability

  Engidraft entire liability, and your exclusive remedy, in law, in equity, or otherwise, with respect to the Application/Website. Content, different types of part drawings, detailed drawings, services and/or for any breach of this agreement is solely limited to the amount you paid, less shipping and handling, for different types of part drawings, detailed drawings, services purchased via the Application/Website.

  Engidraft will not be liable for any direct, indirect, incidental, special or consequential damages in connection with this agreement or the drawings and services in any manner, including liabilities resulting from (1) the use or the inability to use the Application/Website content, drawings and services (2) the cost of procuring substitute drawings and services (3) any drawings or services purchased or obtained or transactions entered into through the Application/Website (4) any lost profits you allege.

  Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages so some of the above limitations may not apply to you.

• Use of Drawings

  Engidraft provide different types of drawings and services consists of detailed drawings, actual drawings, dimension marks, technical details, bill of material, associative notes and many more details (“Drawing Content”) that may be downloaded to your mobile/computer and transferred to your different types of equipments. Drawings content is available for personal, noncommercial use only. Any other use is strictly prohibited. You must use the drawings as provided by Engidraft and you may not use, without prior written consent from Engidraft.

  The drawings service may be used only with those platforms, from which a functional link is made available that, when accessed, takes the viewer directly to the drawings feed on the Application/Website. You may not display the drawings in a manner that does not permit successful linking to, redirection to, or delivery of the applicable page on the Application/Website. You may not insert any intermediate page, splash page or other content between the drawings and the applicable page on the Application/Website.

  You must provide attribution to the appropriate Engidraft Application/Website in connection with your use of the drawings. If you provide this attribution using a graphic, you must use the appropriate Engidraft’s graphics that we have incorporated into the drawings content. Engidraft reserves the right to discontinue to providing drawings and to require that you cease accessing or using the drawings or any elements of the drawings at any time for any reason.

• User Account

  We provide subscription to our services through the creation of user accounts controlled by user mobile number and OTP. If you use Engidraft as a registered user, you are responsible for maintaining the confidentiality of your account and your information and for maintaining restricted access to your computer or smartphone or tablet or like device to prevent unauthorized access to your account.

  You agree to accept responsibility for all activities that occur under your account. You should take all necessary steps to ensure that the account is kept confidential and secure and should inform us immediately if you have any reason to believe that your account has become known to anyone else used in any unauthorized manner. You agree that if you provide any information that is untrue, inaccurate, not current or incomplete or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use.

  We reserve the right to refuse service, or access to Engidraft, terminate accounts, remove or edit content at any time without notice to you.

• Links to Third-Party Websites

  This website may provide links to third-party websites for your convenience and information. If you access those links, you will leave this website. Third party websites will be governed by their own terms and conditions. Engidraft does not endorse companies or products or websites or applications to which it links.

• Trademarks

  The trademarks, logos and service marks (“Marks”) displayed on this Application/Website are the property of Engidraft or other third parties. Users are not permitted to use marks without the prior written consent of Engidraft or the third party that owns the mark. “Engidraft” is a registered trademark of “Salren Engitech”. Other brands and product names are trademarks of their respective owners.

• Indemnification

  You will release, indemnify, defend and hold harmless Engidraft, and any of its contractors, agents, employees, officers, directors, shareholders, affiliates and assigns from all liabilities, claims, damages, costs and expenses, including reasonable attorneys' fees and expenses, of third parties relating to or arising out of (1) this agreement or the breach of your warranties, representations and obligations under this agreement; (2) the Application/Website content or your use of the Application/Website; (3) the drawings or your use of the drawings (including trial drawings); (4) any intellectual property or other proprietary right of any person or entity; (5) your violation of any provision of this agreement; or (6) any information or data you supplied to Engidraft when Engidraft is threatened with suit or sued by a third party, Engidraft may seek written assurances from you concerning your promise to indemnify Engidraft; your failure to provide such assurances may be considered by Engidraft to be a material breach of this agreement. Engidraft will have the right to participate in any defense by you of a third-party claim related to your use of any of the Application/Website content or products, with counsel of Engidraft choice at its expense. Engidraft will reasonably cooperate in any defense by you of a third-party claim at your request and expense. You will have sole responsibility to defend Engidraft against any claim, but you must receive Engidraft prior written consent regarding any related settlement. The terms of this provision will survive any termination or cancellation of this agreement or your use of the Application/Website or drawings or services.

• Privacy

  Please review our Privacy Policy before signing up for using Engidraft. Our Privacy Policy would allow you to fully understand our practices. The personal information / data provided to us by you during the course of usage of Engidraft will be treated as strictly confidential and in accordance with the Privacy Policy and applicable laws and regulations. If you object to any condition in the Privacy Policy governing our use of your information, please do not use Engidraft.

Payment's credentials is always encrypted during transfer over networks.

• Accuracy, Completeness and Timeliness of Information

  We are not responsible for that if information made available on this Application/Website is not accurate, complete, or latest. The drawings/contents on this Application/Website is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.   Drawings and services are available exclusively online through the Application/Website. These drawings and services may have limited accessible to users are based on subscription package only according to our policy.

  We do not warrant that the quality of any drawings, services, information, contents, or obtained by you will meet your expectations, or that any errors in the drawings or service will be corrected.

• Subscription Package

  Engidraft providing different kinds of subscription package based on user uses and requirements of drawings and services in Application/Website. You have to view properly subscription package before subscribe as per your requirements. Engidraft not liable to change, or cancel, or refund for any user subscribed package. Subscription package’s pricing are subject to change without notice at any time. Engidraft reserve the right to change or discontinue any subscription packages at any time on Application/Website. You agree that it is your responsibility to check subscription packages periodically for changes or renewal on Application/Website. Do not subscribe or renew any package of Engidraft Application/Website if you do not agree to details of subscription package. You agree that whenever you change the new subscription package in between old subscription package is running that time all credentials of old package are not convert to new package. Where applicable, we make no guarantee as to the availability of specific subscription package or the minimum amount of subscription package. Engidraft reserve the right to cancel/reject the subscribed package without notice at any time. Additional terms are applicable to subscription package (such as the applicable cancellation and refund policy).

• Modification to the Service and Subscription Package’s Price

  Prices for our subscription packages are subject to change without notice.

  We reserve the right at any time to modify or discontinue the service and subscription package (or any part or content thereof) without notice at any time.

  We shall not be liable to you or to any third-party for any modification of drawings, price change of subscription package, suspension or discontinuance of the service.

• Payment

  You are allowed to choose between various payment options while subscribe the package on Engidraft Application/Website. You agree to use your own payment's credentials for transaction. Engidraft would not be responsible for misuse of your payment credentials if all the security checks and verified. You agree that the methods of payment may be updated from time to time on Engidraft.

  We may use third party payment gateway or other payment mechanisms to process payments of subscription package. Information transmitted is encrypted using standard systems by the payment gateway provider.

  We are not responsible for delays or erroneous transaction execution or cancellation of subscription due to payment issues. We take utmost care to work with third party payment gateway providers, but do not control their systems, processes, technology and work flows, hence cannot be held responsible for any fault at the end of payment gateway providers.

  You agree that Engidraft will not be liable in any manner for any issue relating to such payment mechanisms.

• Cancellation or Modification of Subscribe Package

  Engidraft reserve the right to not allow to cancellation/modification of current subscribe package on Application/Website. You agree that subscription shall not be considered confirmed unless your payment is done. You can only upgrade or downgrade new subscription package with reference to current package.

• Complaint and Refund

  We are sure that you would love our drawings and services. But just in case you were not happy with your experience with us, you can contact us at support@Engidraft.com with complete details and photos of the complaint encountered by you. Engidraft reserve the right to do not refund amount of subscribed package. Engidraft reserve the right to take assesment by technical team for refund payment in such case like subscribed wrong package by mistake, user is not delighted with the services, etc. We shall try to fix the issue amicably.

• Order Rejection

  Engidraft reserve the right to reject any drawings order you placed on Application/Website. We shall discontinue to serve the order of particular users who are misusing the drawings and service without notice at any time. These restrictions may include orders placed by or under the same customer mobile number, and/or orders that use the same billing address. In the event that we make a change to cancel an order, we may attempt to notify you by contacting the e-mail and/or phone number provided at the time registration and/or order reject remark in Application/Website. We reserve the right to limit or prohibit orders that, in our sole judgment.

  You agree to provide proper & accurate dimensions and other related information during the placing the order placed on Application/Website to avoiding orders rejection.

• Accuracy of Account and Billing Information

  You agree to promptly update or change your account information and billing information including your mobile number and email address, so that we can complete your orders and contact you as needed.

• Optional Tools

  We may not provide you with access to third-party tools over which we monitor has any neither control nor input.
